Privacy Policy

This Privacy Policy describes how Yards Direct (“Yards Direct,” “we,” “us,” or “our”) collects, uses, and shares information when you visit yards-direct.com (the “Site”), place an order, request a quote, contact us by phone, or otherwise use our services (collectively, the “Services”).

1. Information We Collect

We collect the following categories of information:

  • Contact information — first and last name, email address, mobile or landline phone number, and (for delivery orders) a delivery address.
  • Order and quote information — products purchased or quoted, quantities, delivery instructions, and order history.
  • Payment information — processed by our payment provider, Square. We do not store full card numbers on our servers.
  • Photos you upload — if you choose to use our yard photo analysis features, the photos you submit and any AI-generated analysis derived from them.
  • Device and usage information — IP address, browser type, pages viewed, referring URLs, and similar information collected automatically through cookies and analytics tools (Google Tag Manager and Google Analytics).
  • Location information — ZIP code or address you provide so we can confirm service-area availability and calculate delivery fees.

2. How We Use Your Information

We use the information we collect to:

  • Process orders and quotes, schedule deliveries, and provide customer support.
  • Send you transactional and operational communications (order confirmations, delivery notifications, scheduling updates, quote responses, and customer service replies).
  • Verify service-area eligibility and calculate accurate delivery pricing.
  • Operate, maintain, secure, and improve the Site and our Services.
  • Comply with legal obligations and enforce our terms.

3. Mobile Phone Numbers and SMS

We do not sell or share your mobile phone number with third parties for their marketing or other independent purposes. We only use your mobile phone number to send you delivery notifications, order and quote updates, customer service replies, and to operate our Services.

Mobile phone numbers and any consent you provide to receive SMS messages are not shared with affiliates, marketers, data brokers, or any other third parties for their own purposes. We only share mobile phone numbers with service providers (such as our SMS delivery vendor) strictly to send you the messages you have opted in to receive.

4. How We Share Information

We share information only with the categories of recipients listed below, and only as needed to provide our Services:

  • Service providers — companies that help us run the Site and fulfill orders, including hosting, payment processing (Square), SMS delivery, email delivery, address geocoding, mapping and routing, and analytics.
  • Delivery and dispatch personnel — drivers and dispatchers receive the information necessary to complete your delivery (name, address, phone number, and order details).
  • Legal and safety — we may disclose information when we believe in good faith that disclosure is required by law, legal process, or to protect the rights, property, or safety of Yards Direct, our customers, or others.
  • Business transfers — if Yards Direct is involved in a merger, acquisition, financing, or sale of assets, your information may be transferred as part of that transaction.

We do not sell your personal information, and we do not share your mobile phone number with third parties for their marketing or independent purposes.

5. Cookies and Analytics

The Site uses cookies and similar technologies to remember your cart, keep you logged in where applicable, and measure how the Site is used. We use Google Tag Manager and Google Analytics to understand aggregate site usage. You can control cookies through your browser settings; disabling cookies may affect Site functionality.

6. Data Retention

We retain personal information for as long as is necessary to provide the Services, comply with legal obligations (including tax and accounting requirements), resolve disputes, and enforce our agreements. Order records are typically retained for at least seven years for tax and recordkeeping purposes.

7. Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

If a security incident results in the unauthorized acquisition of personal information of Texas residents, we will provide notice in accordance with Texas Business & Commerce Code § 521.053, including notification within sixty (60) days of the discovery of the breach where required by law.

8. Your Choices

  • SMS opt-out — reply STOP to any SMS we send to stop receiving messages. Reply HELP for help. See our Messaging Terms for details.
  • Email opt-out — transactional order and delivery emails are required to provide our Services. You may unsubscribe from any non-transactional emails using the link in those emails.
  • Access and correction — contact us using the information below to request access to or correction of personal information we hold about you.

9. Texas Residents and Your TDPSA Rights

Yards Direct is based in Texas and serves customers primarily in Texas. The Texas Data Privacy and Security Act (TDPSA), codified at Tex. Bus. & Com. Code Ch. 541, provides Texas residents with specific rights regarding their personal data. While Yards Direct may currently qualify as a small business under the U.S. Small Business Administration size standards referenced in the TDPSA, we extend the core consumer rights described in this section to Texas residents as a matter of policy.

Categories of Personal Data We Process

For Texas residents, the categories of personal data we process and the purposes of processing are:

  • Identifiers (name, email, phone number, customer or account identifiers) — to fulfill orders, send delivery and account communications, and provide customer support.
  • Commercial information (orders, quotes, products viewed, transaction history) — to operate our store, process payments, and respond to customer inquiries.
  • Geolocation (delivery address and ZIP code; not precise device-level geolocation) — to confirm service-area eligibility, calculate delivery fees, and route deliveries.
  • Internet or network activity (IP address, browser type, pages viewed, referring URL) — to operate, secure, and improve the Site.
  • Visual information (yard photos you upload) — only when you choose to use our yard analysis features, to generate product recommendations.
  • Payment information (handled by Square; we do not store full card numbers) — to process payments for orders.

Categories of Third Parties

We share personal data only with the categories of third parties listed in Section 4 above — specifically, our hosting, payment, SMS, email, geocoding, mapping, and analytics service providers; delivery and dispatch personnel; and where required by law.

What We Do Not Do

  • We do not sell personal data for monetary or other valuable consideration.
  • We do not process personal data for targeted advertising.
  • We do not engage in profiling in furtherance of decisions that produce legal or similarly significant effects concerning a consumer.
  • We do not knowingly process sensitive personal data as defined by the TDPSA (such as racial or ethnic origin, religious beliefs, mental or physical health diagnosis, sexual orientation, citizenship or immigration status, genetic or biometric data, precise geolocation, or personal data of a known child).
  • We do not collect biometric identifiers within the meaning of Texas Bus. & Com. Code § 503.001 (the Capture or Use of Biometric Identifier Act). Yard photos that you upload are images of property and are not used to identify any individual.

Your Rights

Texas residents may exercise the following rights with respect to their personal data:

  • Right to confirm and access — confirm whether we are processing your personal data and obtain a copy of it.
  • Right to correct — correct inaccuracies in your personal data, taking into account the nature of the data and the purposes of processing.
  • Right to delete — delete personal data we have collected about you, subject to legal exceptions (for example, where we are required to retain order records for tax or fraud-prevention purposes).
  • Right to data portability — obtain a copy of your personal data in a portable and, to the extent technically feasible, readily usable format.
  • Right to opt out — opt out of the sale of personal data, processing for targeted advertising, and profiling in furtherance of legally or similarly significant decisions. As noted above, we do not engage in any of these activities.

How to Exercise Your Rights

To exercise any of these rights, contact us at mpayne@aproservco.com or by phone at (512) 277-3156. We will respond within forty-five (45) days of receipt of your verifiable request, with one additional 45-day extension where reasonably necessary, as permitted under the TDPSA. We may need to verify your identity before fulfilling your request.

Right to Appeal

If we decline to take action on your request, you may appeal that decision by replying to our written response or by emailing mpayne@aproservco.com with the subject line “TDPSA Appeal.” We will respond to your appeal within sixty (60) days. If your appeal is denied, you may submit a complaint to the Texas Attorney General’s Consumer Protection Division.

10. Children

The Site and Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided us with personal information, please contact us and we will delete it.

11. Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will revise the “Effective date” at the top of this page. Material changes will be communicated through the Site or by other reasonable means.
